“Seller Beware: Unregistered Vehicle Sale Sparks $1500 Bill”

Darrell Nash, a retired truck driver living near Langley, B.C., encountered a surprising issue after selling his used SUV last spring. Despite his experience in vehicle transactions, Nash was hit with a $1,500 towing and storage bill for a vehicle he no longer owned due to what he describes as a concerning oversight in the handling of vehicle transfers.

The incident unfolded when Nash’s grandson, while Nash was in the hospital recovering from heart surgery, sold their 2004 Acura MDX to a stranger for $500 cash. The vehicle, with over 300,000 kilometers and mechanical problems, was sold with proper transfer forms filled out by the buyer, who then drove off with the vehicle.

Months later, the RCMP contacted Nash, revealing that the vehicle had been abandoned, uninsured, and still registered in his name. Despite providing proof of the sale, Nash found himself facing demands for payment from a towing company, as the buyer had not registered the vehicle in their name as required by law.

Legal experts point out that this situation is not unique to Nash and could affect anyone selling a vehicle in most parts of Canada. The issue lies in the fact that only buyers are mandated to transfer registration at the vehicle registry office, leaving sellers vulnerable if buyers fail to fulfill this obligation.

While some provinces like Nova Scotia and Newfoundland and Labrador have closed this loophole by implementing safeguards that protect sellers, most provinces rely on buyers to complete registration without ensuring compliance. Nash advocates for a simple fix where sellers submit a notice of sale to transfer responsibility to the buyer officially.

Despite the availability of solutions, provinces such as B.C., Alberta, Ontario, and Saskatchewan have been slow to adopt legislative changes, leaving sellers like Nash exposed to potential liabilities. Nash’s ordeal serves as a cautionary tale for individuals selling vehicles privately, emphasizing the importance of ensuring proper registration transfer to avoid similar complications.
