Democratic Senator Mark Kelly has filed a lawsuit against the Pentagon for alleged attempts to penalize him for speaking out against illegal orders given to U.S. troops, claiming his constitutional right to free speech was violated by the Trump administration. Kelly, a retired astronaut and former U.S. navy pilot representing Arizona, is seeking to halt the censure imposed by U.S. Defence Secretary Pete Hegseth last week. Hegseth’s censure, issued on Jan. 5, could potentially lead to a demotion from Kelly’s retired captain rank and a subsequent reduction in retirement benefits.
Kelly has petitioned the federal court in Washington, D.C., to declare the censure letter, rank-related proceedings, and any other punishments unlawful and unconstitutional. His lawsuit argues that government officials are prohibited by the First Amendment from punishing or retaliating against protected speech, especially when it involves legislators discussing public policy matters.
The case has been assigned to U.S. District Judge Richard Leon, appointed by former Republican President George W. Bush. This legal action of a sitting senator challenging the defence secretary is uncommon and reflects lawmakers’ efforts to counter what they perceive as an overreaching executive branch. The censure stemmed from a video in November 2025 featuring Kelly and five other Democratic lawmakers, all veterans, urging troops to uphold the Constitution and resist “illegal orders.”
Despite facing backlash, Kelly and his colleagues have stood by the video’s message. President Donald Trump labeled their actions as “sedition,” which he claimed could warrant the death penalty. The Pentagon initiated an investigation into Kelly late last year, invoking a federal law that allows retired service members to be called back to active duty for potential disciplinary actions. While all six lawmakers in the video have military or intelligence backgrounds, Kelly is the sole focus of the investigation due to his formal military retirement status falling within the Pentagon’s jurisdiction.
Kelly, in a statement, emphasized his commitment to defending the rights of fellow Americans who have served in defense of freedoms. He criticized Hegseth for attempting to stifle dissent by threatening military veterans with rank and pay repercussions, asserting that such actions are incompatible with the principles of the United States.
